Skillversity.com – Terms and Conditions ( UNDER THE AEGIS OF KAMYOG KMPY EDUCATION FOUNDATION)

1. Acceptance of Terms

  • Course descriptions, pricing, and schedules are subject to change without notice.

  • Skillversity does not endorse, and is not responsible for, the accuracy, completeness, or quality of the Content provided by Instructors.

  • You are solely responsible for evaluating the suitability of a Course for your needs.

  • Skillversity may, at its sole discretion, remove or modify any Course or Content that violates these Terms or is otherwise objectionable.

6. Fees and Payment

  • Fees for Courses are as listed on the Website.

  • You agree to pay all applicable fees in the currency specified.

  • Payment can be made through the payment methods provided on the Website (e.g., credit card, debit card, net banking, UPI, wallets).

  • You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content, except as expressly permitted by these Terms or with the prior written consent of Skillversity.

  • You retain ownership of your User-Generated Content. By submitting User-Generated Content, you grant Skillversity a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, create derivative works of, publicly display, publicly perform, and otherwise exploit your User-Generated Content in connection with the Services and Skillversity’s business.

  • You represent and warrant that you own or have the necessary rights and permissions to grant the foregoing license for your User-Generated Content.

8. User Conduct

You agree not to:

  • Violate any Applicable Law.

  • Upload, post, or transmit any viruses, worms, or other malicious code.

  • Harass, threaten, or abuse other users or Instructors.

  • Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

  • Infringe upon the intellectual property rights of Skillversity or any third party.

  • Collect or store personal data about other users without their express consent.

  • Engage in any commercial activities without our prior written consent.

  • Circumvent or attempt to circumvent any security measures implemented by Skillversity.

9. User-Generated Content

  • You are solely responsible for your User-Generated Content.

  • Skillversity does not endorse and is not responsible for the accuracy, completeness, or quality of User-Generated Content.

  • Skillversity may, but is not obligated to, monitor, review, edit, or remove User-Generated Content at its sole discretion.

  • You agree to indemnify and hold Skillversity harmless from any claims arising out of your User-Generated Content.

10. Termination

  • Skillversity may terminate or suspend your access to the Services, with or without cause, at any time and without prior notice.

  • You may terminate your Account at any time by following the instructions on the Website.

  • Upon termination, your right to use the Services will immediately cease.

  • Sections concerning Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution shall survive termination.

11. Disclaimers

  • SKILLVERSITY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

  • SKILLVERSITY DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT.

  • YOU USE THE SERVICES AND CONTENT AT YOUR OWN RISK.

  • Skillversity is not responsible for the conduct, whether online or offline, of any user of the Services.

12. Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKILLVERSITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR CONTENT, EVEN IF SKILLVERSITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  • TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKILLVERSITY’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES OR CONTENT SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO SKILLVERSITY IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

  • The limitations and exclusions of liability in this section apply regardless of the theory of liability, whether based on contract, tort (including negligence), strict liability, or any other legal theory.

  • Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations and exclusions may not apply to you. In such jurisdictions, Skillversity’s liability will be limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Skillversity, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your User-Generated Content, your violation of these Terms, or your violation of any rights of any third party.

14. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.

  • Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in [City, State – e.g., Bangalore, Karnataka].

  • Entire Agreement: These Terms, together with the Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and Skillversity concerning the Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Skillversity.

  • Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

  • Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

  • Assignment: You may not assign these Terms or any of your rights or obligations hereunder without Skillversity’s prior written consent. Skillversity may assign these Terms or any of its rights or obligations hereunder without your consent.

  • Notices: All notices to Skillversity must be in writing and sent to [Email Address] and [Physical Address]. Notices to you may be sent to the email address or physical address associated with your Account.

  • Force Majeure: Skillversity shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

  • Relationship of the Parties: Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between you and Skillversity.

  • Third-Party Beneficiaries: These terms do not and are not intended to confer any rights or remedies upon any person other than the parties.
